Terms and Conditions

These general terms and conditions are prepared in accordance with the Consumer Protection Act (ZVPot-1), the Electronic Commerce Market Act (ZEPT), and the Personal Data Protection Act (ZVOP-2), based on the recommendations of the Chamber of Commerce and Industry of Slovenia.

The online store is operated by DEJAN PIRC S.P. (hereinafter: the "provider"). These general terms and conditions govern the operation of the online store, the rights and obligations of the buyer, and regulate the business relationship between the provider and the buyer.

1. Offer and Order

The online sales on the Art by Urska website include the sale of original artworks (paintings) and, by agreement, the creation of custom-made paintings (orders).

Orders are placed directly through the online checkout (Stripe) or by sending an inquiry via the contact form for payment by proforma invoice.

Before placing an order, the buyer has the opportunity to review and correct entered data and any errors. All information about the product, price, delivery, and terms is available before completing the order.

The sales contract between the provider and the buyer is concluded at the moment the buyer receives a confirmation email about successful payment or order confirmation. The provider stores the order and can, if necessary, provide it to the buyer in electronic form.

The contract may be concluded in Slovenian or English, depending on the selected language version of the website.

2. Prices and Payment

All prices on the website are expressed in euros (EUR) and already include VAT, as the provider is VAT liable.

Payments are made through the secure Stripe payment system (Visa, Mastercard, American Express credit cards, Apple Pay, and Google Pay) or by proforma invoice to the company's bank account based on an issued offer.

3. Production, Dispatch, and Delivery Times

• Available paintings: Dispatched within 3–5 business days from receipt of payment.
• Custom-made paintings: Production and dispatch time is determined individually upon order confirmation (usually 2–6 weeks).

Delivery is carried out by Pošta Slovenije or partner courier services (DHL, DPD, etc.). Detailed terms are defined on the Delivery and Returns page.

4. Product Conformity and Limitation of Liability

The provider strives to provide accurate photographs and descriptions of artworks, but minor color deviations may occur due to the buyer's screen settings. Original paintings are unique handmade works, so texture irregularities are an integral part of the artwork.

The provider is liable for material defects or non-conformity of the goods with the contract in accordance with applicable legislation. In such cases, the buyer may exercise rights arising from non-conformity of goods.
